If a Tow Truck Mentions ‘Compliance’, Ask This Question

At a stressful roadside incident, you might hear a tow operator use official-sounding words like “compliance,” “regulations,” or “protocol.” They’ll say things like, “For compliance reasons, we have to take it to our yard,” or, “Our protocol requires an upfront sign-off.”

This language is often a deliberate tactic. It is designed to make you feel like you are dealing with a non-negotiable rule, when in reality you are dealing with a company policy designed to benefit them, not you.

"Compliance" Is Not a Universal Law That Benefits Them

Towing in Western Australia is regulated, but those regulations are primarily focused on safety, licensing, and consumer protection. They do not force you to:

  • Agree to have your car taken to a specific yard.
  • Sign a blank or vague authorisation form.
  • Pay an unquoted amount.

When a tow operator uses the word “compliance,” they are often referring to their own internal company rules, and framing them as if they are official government regulations. They are leveraging your lack of knowledge of the specific laws to push you into an agreement that serves their interests.

The One Question That Cuts Through the Jargon

If a tow operator uses the word “compliance” or “regulation” to justify an action you are not comfortable with, you only need to ask one simple, powerful question:

“Can you please show me the specific government regulation you are referring to?”

This question immediately puts them on the spot. If they are referring to a genuine WA law (which is unlikely), they should be able to name it or at least explain it clearly. If they are just quoting their own company policy, they will be unable to answer. Their hesitation is your confirmation that you are being misled.

Red Flags Dressed Up as Rules

Be especially wary if “compliance” is used to justify:

  • Forcing you into their storage yard: This is a classic setup for inflated storage fees.
  • Refusing to give a price: There is no regulation that prevents a quote.
  • Demanding a signature before explaining the cost: Your signature is consent. Don’t give it away blindly.
